Attorney Jones Receives Approval for Motion to Reopen from Board of Immigration Appeals

Fayad Law, P.C. is pleased to announce that Attorney Tamar Jones has received approval for a Motion to Reopen (MTR) that she filed with the Board of Immigration Appeals on behalf of a client. Attorney Jones’s client entered the United States on a B-2 visitor visa and timely applied for asylum. The case was referred to an immigration judge and subsequently denied. The client appealed his case to the Board of Immigration Appeals (BIA). The appeal was also subsequently dismissed.

During the time that his BIA appeal was pending, our client married a U.S. citizen, so Attorney Jones and our team filed an I-130 petition. An I-130 petition can be filed by a U.S. citizen and is the first step in sponsoring a foreign-born spouse for permanent residency in the United States. While the I-130 petition was pending, we timely filed a motion to reopen with the BIA, based on the availability of new relief (adjustment of status).

The I-130 petition was recently approved, and on July 30, 2014 we received approval of the Motion to Reopen from the BIA. Attorney Jones and the firm are pleased to have achieved this positive result for our client and his family.
