H-1B Cap Registration Season Ends on March 25

The cap registration period for H-1B work visas is now open but ends on March 25, the U.S. Citizenship and Immigration Services (USCIS) has announced.

All cap registrations must be completed and submitted online before noon EDT on March 25. By March 31, USCIS will notify sponsoring employers of selected entries after conducting the FY 2022 H-1B cap selection.

The current quota for registrations is 85,000. Should the number of registrations USCIS receives exceed this quantity, it will conduct a random computerized lottery to select registrations that can proceed toward filing the H-1B cap petition. Unfortunately, this means not all registrations received can result in visa. USCIS is also stating it will not use a wage-based selection system during this cap season.

Should a lottery occur, it will be conducted in two portions. The first portion will randomly select 65,000 registrations from all that were received. The second portion would target 20,000 of those who earned advanced degrees in the U.S. and were not selected during the first portion of the lottery.

Employers must seek legal counsel to help them prepare their H-1B cap registration before noon on March 25. Once this has been completed, USCIS will generate a passcode that you can use to review, approve, and electronically sign the registration.
