Client Receives Favorable Decision After Reasonable Fear Interview

GET THE LEGAL HELP YOU NEED

Thousands of immigrants seek asylum in the United States each year. Fayad Law, P.C. recently assisted a client who had illegally entered the United States multiple times out of fear of being targeted by organized crime cartels because of his familial ties. His first illegally entered the country in the 1990s, and despite the fact that he had been deported and returned to his country more than once, he felt he had no other choice but to return to the U.S. in 2013. He was once again detained by immigration officials.

When he retained our counsel, he already had a prior order of removal, and was thus ineligible to be released on a bond or fight for asylum relief in the immigration court. We scheduled a reasonable fear interview for our client with the asylum office. Our client was able to plead his case and show evidence of the direct threats he had received on his own life, as well as the fact that his brother and cousin had already been murdered by the same individuals from whom he was trying to escape.

The asylum office agreed that our client had established a reasonable possibility that he would be tortured or killed if he returned to Mexico, and they issued their determination in our client’s favor. With this favorable determination we are now able to help our client seek withholding of removal relief and we are working to obtain his release while his immigration court case is pending.

In regards to the case, Attorney Tamar Jones said: “I am very pleased with the outcome of our client’s reasonable fear interview. Like many individuals he sought refuge in the United States because he feared for his safety in his home country. Even after being deported he was so afraid for his life that he felt he had no recourse but to re-enter the U.S. again. Thankfully, the reasonable fear interview option was available to him and he received a favorable determination. Now he will be able to seek longer term relief in the immigration court. He still has work ahead, but gaining a favorable determination from the asylum office was huge hurdle. I’m looking forward to helping him along the rest of the journey!”
